ONE PRIZE: $2,500.00 USD Visa Gift Card, donated by Garrett Enterprises of Tampa, Inc. Only one winner will be selected.

ONE PRIZE: 2 Round Airline Tickets on Delta airlines anywhere in the Continental United States, Canada or Mexico. Only one winner will be selected donated by Garrett Enterprises of Tampa, Inc.

ONE PRIZE: Winner will receive a LCD 42” Television with an estimated value of $1,000.00, donated by Garrett Enterprises of Tampa, Inc. Only one winner will be selected.

ONE PRIZE: Nintendo Wii, donated by Garrett Enterprises of Tampa, Inc. Only one winner will be selected.

Independent Community School (“Sponsor”) & Garrett Enterprises of Tampa, Inc., Rolls Royce Raffle (the “Raffle”) begins at 6:00 AM Eastern Daylight Savings Time (“EDST”) on February 4, 2009 and ends at 5:00 PM EDST on May 18, 2009 (“Entry Period”).

ELIGIBILITY: Entrants must be legal residents of one of the 50 United States or the District of Columbia (excluding residents of Puerto Rico). Entrants must be 18 years of age or older at the time of Raffle registration. Void where prohibited by law, rule or regulation. All federal, state and local laws and regulations apply. Employees of Garrett Enterprises of Tampa, Inc., and their immediate family members are not eligible to participate. “Immediate family” includes only spouses, parents and children living in the same household.

TO ENTER: There are two ways to enter the Raffle.

(1) During the Entry Period, make an online contribution of at least $50.00 to the Independent Community School by following the following steps: visit www.RollsRoyceRaffle.com Click on the GET TICKET tab. Under the _____ column, locate and click on Rolls Royce Fundraiser. Enter currency amount of $50.00 or more in the text box and press continue. Follow the directions for your credit card/check information, electronic entries will be deemed made by the authorized account holder of the e-mail address submitted at time of entry; or
(2) To enter with or without making the suggested minimum contribution, print your name, address, phone number, email address, and date of birth on a 3x5 card, affix proper postage and mail it to Independent Community School., attn: Rolls Royce Fundraiser, 418 E. Emily St., Tampa, FL 33603. Internet entries must be transmitted on or before May 18, 2009 at 5:00 p.m. EDST. Mail-in entries must be post-marked by May18, 2009 and received by Sponsor by May 22, 2009. All entries become the property of Sponsor and will not be returned or acknowledged. Sponsor is not responsible for incomplete, misdirected, delayed, undelivered, inaccurate, late, postage due, garbled entries, mutilated, or illegible entries, or for incorrect or inaccurate transcription of entry information, or for entries that for any reason are not received by Sponsor by the stated deadlines.

NO PURCHASE OR CONTRIBUTION NECESSARY TO ENTER OR WIN.

DRAWING AND NOTIFICATION OF PRIZE WINNERS: Only one prize permitted per person. Winners will be selected by a random drawing on May 23, 2009. Sponsor reserves the right to modify scheduling of the Raffle without prior notice. Sponsor will award prizes only upon winner verification. Decisions by Sponsor of winner eligibility, notification, and acceptance or disqualification will be final and binding. Winner will receive prize notification by e-mail to the e-mail address registered upon entry. The winner will be required to execute and return to Sponsor an Affidavit of Eligibility within ninety (15) days following attempted notification. Entrants need not be present to win.

All winners will have fifteen (15) days after notification to accept the prize or will be disqualified and an alternate winner selected. All winners must pick up prizes before June 23, 2009 or forfeit the prize.

If the selected winner has not complied with the Official Rules, cannot be contacted by e-mail, is ineligible, the Prize Notification or prize is returned as undeliverable, or if the winner does not return the executed Affidavit of Eligibility within the specified time period, an alternate winner will be selected. Acceptance of a prize constitutes permission for Sponsor to use winner’s name and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law. The first name, last initial, city, and state of winners will be posted on www.rollsroyceraffle.com following the drawing.

PRIZE RESTRICTIONS: Winner is solely responsible for pick-up or delivery of the vehicle. All taxes, title, tag, registration, customs, duty, import, and brokerage fees (if any) are the sole responsibility of the winner. No more than the stated number of prizes will be awarded. In the event that production, technical, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims. Prize is not transferable or redeemable for cash and prize substitutions will not be allowed, except that Sponsor reserves the right to substitute a prize with another prize of greater or equal value in the event that a prize is unavailable. Any taxes, fees, or incidental costs including but not limited to income taxes that may arise and be due or asserted on account of the prize shall be the sole responsibility of the winner. A MISC 1099 tax form will be issued to the winner. There is no warranty of any type on the vehicle awarded except as may be offered by the manufacturer or as otherwise required by law. Potential winner must have both a valid license to operate the motor vehicle and proof of insurance at the time the prize is awarded.

ODDS: Odds of winning depend on the number of entries received.

PUBLICITY RELEASE: Winner agrees that acceptance of a prize grants Sponsor the right to print, publish, broadcast, and use universe-wide in any media now known or later developed at any time or times, the winner’s name, portrait, picture, voice, likeness, and biographical information for any purpose, including but not limited to, in advertisements, publicity, and other communications without additional compensation, except where prohibited by law.

RELEASE: As a condition of entering the Raffle, entrant agrees that (1) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses; (2) all causes of action arising out of or connected with this Raffle, or any prizes awarded, shall be resolved individually, without resort to any form of class action; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorney’s fees. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

BY ENTERING THE RAFFLE, ENTRANTS AGREE TO RELEASE, DISCHARGE AND HOLD HARMLESS INDEPENDENT COMMUNITY SCHOLL AND GARRETT ENTERPRISES OF TAMPA, INC., AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS, (“RELEASED PARTIES”) FROM ANY AND ALL LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, WHETHER DIRECT OR INDIRECT, WHICH MAY BE DUE TO OR ARISE OUT OF PARTICIPATION IN THE RAFFLE OR ANY PORTION THEREOF, OR THE ACCEPTANCE, USE/MISUSE OR POSSESSION OF PRIZE, OR ANY PRIZE RELATED ACTIVITY. ENTRANTS WAIVE ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

CHOICE OF LAW AND JURISDICTION: Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants or winner, and Sponsor in connection with this Raffle, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Florida or any other jurisdiction) that might otherwise cause the application of the laws of any jurisdiction other than the State of Florida. Any action seeking legal or equitable relief arising out of or relating to the Raffle or these Official Rules shall be brought only in the courts of the State of Florida located in Hillsborough County.
